Janis offers perspective as ‘Supreme Court adopts new standard for patent invalidity’

Mark Janis weighed in on the U.S. Supreme Court’s unanimous ruling on assessing the invalidity of a patent:

“The court may have felt that it was sending a strong signal to the Federal Circuit, the lower courts and the PTO [Patent and Trademark Office] to scrutinize patents more closely for indefiniteness, but I think that the test that the court adopted is itself quite indefinite.”
